Surfed operates an online marketplace that enables users to list, discover, and communicate about surf-related goods and services, including surfboards, wetsuits, accessories, and repair services.
Surfed acts solely as a platform facilitator and is not a party to transactions between users unless explicitly stated otherwise. Any sale or purchase agreement is made directly between buyers and sellers.
2. User Accounts and Responsibilities
By using Surfed, users agree to:
- Provide accurate and complete information when creating an account or listing items
- Ensure all listings are truthful, lawful, and not misleading
- Maintain the security of their account credentials
- Communicate honestly and respectfully with other users
- Only list items they own or are authorised to sell
Users are responsible for all activity conducted through their account.
3. Listings and Content Standards
Users must ensure that all listings:
- Accurately describe the item or service offered
- Include correct condition, pricing, and relevant specifications
- Do not contain false, deceptive, or exaggerated claims
- Comply with applicable laws and regulations in New Zealand
Surfed reserves the right to remove or modify listings that do not meet platform standards.
4. Prohibited Items and Conduct
Users must not list, promote, or facilitate:
- Illegal, stolen, counterfeit, or fraudulent goods
- Harmful, unsafe, or prohibited products
- Misleading or deceptive content
- Harassment, abuse, or discriminatory behaviour
- Spam or manipulative activity designed to distort marketplace activity
Surfed may suspend or permanently restrict accounts that breach these rules.
5. Transactions and Disputes
All transactions are conducted directly between users. Buyers and sellers are solely responsible for:
- Inspecting items prior to purchase where possible
- Agreeing on pricing, payment methods, and delivery or pickup terms
- Ensuring safe and lawful exchange of goods or services
Surfed does not guarantee the quality, safety, legality, or performance of listed items. While Surfed may provide support or mediation where appropriate, it is not obligated to resolve disputes.
6. Subscriptions and Featured Listings
Surfed may offer paid subscription plans and promotional listing features that enhance visibility within the marketplace. These services affect placement and exposure only and do not guarantee sales, engagement, or transaction outcomes.
All subscription fees and promotional purchases are non-refundable unless required by applicable law.
7. Forecast, Recommendations, and Informational Content
Surf forecasts, wave conditions, and related environmental data provided on Surfed are for informational purposes only.
- Forecast data may be inaccurate, delayed, or incomplete
- Surfed does not guarantee safety or suitability of surf conditions
- Users are responsible for their own judgement and safety decisions
Any product recommendations, surfboard matching tools, or AI-based suggestions are advisory only and do not constitute professional or safety advice.
8. Repair Listings and Services
Surfed may facilitate listings for surfboard repair services and related offerings. However:
- Surfed is not responsible for workmanship, pricing, timelines, or outcomes
- All repair agreements are made directly between users and service providers
- Users are responsible for assessing suitability and quality of repair providers
9. Limitation of Liability
To the maximum extent permitted by law, Surfed is not liable for:
- Losses arising from transactions between users
- Damaged, misrepresented, or defective goods
- Service disputes between users
- Reliance on forecast or recommendation tools
- Any indirect, incidental, or consequential damages
Use of the platform is at the user's own risk.
10. Account Suspension and Termination
Surfed reserves the right to suspend or terminate accounts, remove listings or content, and restrict access to features where users breach these Terms or where necessary to protect platform integrity or other users.
11. Changes to These Terms
Surfed may update these Terms & Conditions from time to time. Continued use of the platform after changes are published constitutes acceptance of the updated terms.
