1. Overview
These Subscription Terms govern all paid subscription plans and promotional services offered by Surfed ("Platform"). By purchasing a subscription, you agree to these Terms in addition to Surfed's Terms & Conditions and Vendor Agreement.
2. Subscription Services
Surfed may offer recurring subscription plans for Vendors and/or users, which may include:
- Increased listing capacity
- Enhanced search ranking
- Priority placement in marketplace feeds
- Access to analytics and insights
- Eligibility for algorithmic recommendations
- Access to promotional tools and features
Subscription features vary depending on the selected plan.
3. Billing and Payments
All subscriptions are billed on a recurring monthly basis unless otherwise stated. By subscribing, you authorise Surfed (or its payment provider, such as Stripe) to:
- Charge the applicable subscription fee
- Automatically renew your subscription at the end of each billing cycle
All fees are stated in New Zealand Dollars (NZD) unless otherwise specified.
4. Renewal
Subscriptions automatically renew at the end of each billing cycle unless:
- You cancel your subscription before the renewal date, or
- Your account is suspended or terminated by Surfed
Renewal will occur at the then-current subscription rate.
5. Cancellation
You may cancel your subscription at any time via your account settings or by contacting support. When you cancel:
- Your subscription will remain active until the end of the current billing period
- You will not be charged for subsequent periods
- No partial refunds are provided for unused time unless required by law
6. Refund Policy
Subscription fees are generally non-refundable, including:
- Partial months of service
- Unused features or benefits
- Failure to achieve sales or listing performance
Refunds may only be issued where required under applicable consumer law or at Surfed's sole discretion.
7. Featured Listings and Paid Promotions
Certain subscription tiers may include or offer access to promotional services such as:
- Featured listings
- Boosted visibility in search results
- Homepage or category placement
- Surf-condition-based recommendation exposure
Additional promotional boosts may also be purchased separately.
Important:
- Featured placements are time-limited unless otherwise stated
- Placement is determined by Surfed's ranking and algorithm systems
- No subscription guarantees sales, traffic, or engagement
8. Ranking and Algorithmic Exposure
Subscriptions may influence how listings are ranked within Surfed, including search ranking priority, recommendation engine exposure, feed placement, and surf forecast-based matching visibility. However:
- Surfed does not guarantee specific ranking positions
- Ranking systems may change at any time to improve platform performance
9. Price Changes
Surfed reserves the right to modify subscription pricing at any time. If pricing changes:
- Existing subscribers will be notified in advance where required by law
- Changes will apply upon renewal of the subscription period
- Continued use of the service after renewal constitutes acceptance of new pricing
10. Account Suspension and Termination
Surfed may suspend or terminate subscriptions if:
- There is a breach of platform policies
- Fraudulent, abusive, or misleading activity is detected
- Payment failures occur repeatedly
- Required by legal or regulatory obligations
Suspension may result in loss of subscription benefits.
11. Payment Failures
If a payment fails:
- Surfed may attempt to retry payment
- Access to subscription features may be temporarily restricted
- Continued failure may result in cancellation of the subscription
Users are responsible for ensuring valid payment details are maintained.
12. Platform Changes
Surfed may update, modify, or discontinue subscription features at any time, including adjustments to ranking systems, changes in featured placement logic, and addition or removal of features within tiers. Surfed will aim to ensure reasonable continuity of service.
13. No Guarantee of Performance
Subscriptions improve visibility and access within the Surfed marketplace but do not guarantee:
- Sales or transactions
- User engagement
- Listing views or conversions
- Business outcomes
Performance is influenced by market demand, user behaviour, and external conditions.
14. Taxes
All prices are inclusive or exclusive of applicable taxes as stated at checkout. Users are responsible for any additional tax obligations that may apply in their jurisdiction.
15. Governing Law
These Subscription Terms are governed by the laws of New Zealand.
